The Darien, CT Sod Guide: Tokeneke to Ox Ridge, the 50-Foot Rule, and No Sunday Ordinance

As of September 2026, Darien is the one Gold Coast town between Greenwich and Westport whose current code shows no adopted hours-based construction ordinance. It has the tightest wetlands review distance on the shoreline, 50 feet and not 100, Aquarion’s two-day watering schedule, and lots that run from a third of an acre in Noroton Heights to two acres on Middlesex Road. This guide covers how sod installation works on each kind of Darien property, what the town actually regulates, when to install, and how to size a job before the first truck shows up.

As of September 2026, here is what installing sod in Darien, CT involves.

• Wetlands: the Environmental Protection Commission reviews any regulated activity within 50 feet of a wetland or watercourse. For 13 square miles, Darien has a lot of shoreline, ponds, and tidal marsh, so the 50 feet reaches more lawns than the number suggests.
• Regrading and topsoil: Section 851 of the Zoning Regulations sets the threshold for a Land Filling, Excavation and Regrading special permit. Owner-performed landscaping under 20 cubic yards is exempt; finish grading or topsoiling that changes contour no more than 6 inches is also exempt. Work that crosses those lines generally requires a permit from the Planning and Zoning Commission, and shore lots in a FEMA flood zone add a Flood Damage Prevention application. A big topsoil lift is a permit question before it is a truck question.
• Crew hours: no adopted hours-based ordinance has been found in Darien as of September 2026. The town code at Section 31-7 adopts the state noise regulations, which set decibel limits by day and night rather than permitted hours. A 2023 proposal to add hours went to the RTM and has not been adopted.
• Leaf blowers: no adopted Darien restriction has been found as of September 2026. A town survey on gas-powered blowers was underway in August 2026; the outcome is not yet determined.
• Watering: Aquarion’s mandatory two-day sprinkler schedule runs April 1 through October 31. Even addresses water Sunday and Wednesday, odd addresses Saturday and Tuesday, 12:01 to 10 a.m. or 6 p.m. to midnight. Hand-held, soaker, and drip are allowed anytime. New sod qualifies for a New Planting Variance, which is unavailable in July and August; apply before the install.
• Best windows: September through October, then April through early June.
• Best sod: salt-tolerant tall fescue or RTF on the shore streets, Kentucky bluegrass in irrigated full sun inland, tall fescue on unirrigated clay.

Darien is 13 square miles with the Sound on one side and the Noroton and Five Mile Rivers on the other two. What is under a lawn changes in a quarter mile.

What Darien Actually Regulates

Wetlands: The EPC and the 50-Foot Rule

Darien’s Planning and Zoning FAQ says it plainly: a project needs Environmental Protection Commission approval if it is within 50 feet of a wetland or watercourse. That is the town’s regulated area under its Inland Wetlands and Watercourses Regulations, last updated in April 2016. It is half the distance Greenwich uses and the same as New Canaan’s wetland distance, but Darien has more water per acre than either: Holly Pond, Gorham’s Pond, the Goodwives River, Stony Brook, the Noroton River on the Stamford line, the Five Mile River on the Norwalk line, and the tidal marsh behind nearly every shore street.

What triggers review is grading, filling, and removing material, not laying sod. Within 50 feet of a wetland or watercourse, these count as regulated activities:

• Removing the old lawn with a sod cutter or a skid steer where it changes grade
• Bringing in topsoil, fill, or compost and spreading it
• Regrading, even to fix a low spot
• Clearing vegetation along a pond, brook, or marsh edge
• Changing where the water goes: drainage, swales, downspout extensions

Regrading and Topsoil: Section 851 and the Land Filling, Excavation and Regrading Permit

This is the Darien rule most sod guides miss, and it is the one that decides whether the topsoil trucks can come next week or next month. Section 851 of the Darien Zoning Regulations (amended through May 10, 2026) sets the thresholds for when the Land Filling, Excavation and Regrading permit is required.

The exemptions in Section 851 matter as much as the trigger. Owner-performed landscaping under 20 cubic yards is exempt. Finish grading or topsoiling that changes the existing contour by no more than 6 inches is also exempt. Staff may approve work under 50 cubic yards, or finish grading and topsoiling that changes contour by no more than 8 inches, if the adjoining property is unaffected; that category does not automatically require a public hearing. Work that crosses the higher thresholds—volume, contour change, or impact on adjoining lots—generally requires a special permit from the Planning and Zoning Commission, which does involve a hearing and a stormwater plan where the regulations require one.

Scale that against the lot math below. A one-pallet repair in Noroton Heights with a few yards of screened loam raked into the existing grade is almost certainly under the owner-landscaping exemption or the finish-grading exemption. A three-inch topsoil lift on a 25,000-square-foot Ox Ridge lawn is 231 yards, twelve tri-axle loads, and squarely in the range where the answer is ask P&Z first before ordering trucks. The applications on recent P&Z agendas—regrading and fill for a new house and pool on Old Farm Road, a 400-yard fill on a shore lot, a 350-yard cut for retaining walls, a 650-yard clean-soil cap on Great Island—show the kind of work that ends up on the hearing calendar.

A separate item: Darien adopted a Stormwater Management Manual with a Form 880-01 stormwater exemption for small projects. That form is a stormwater process, not a substitute for the Section 851 grading-volume analysis; they address different requirements and can apply simultaneously or independently.

Two additional reviews apply on the water. Lots in a FEMA flood zone—Holly Lane, Hecker Avenue, Nearwater Lane, and most of the Noroton Bay and Long Neck Point streets—need a Flood Damage Prevention application before fill goes in, because fill in the floodplain is regulated whether or not a wetland is nearby. Lots inside Connecticut’s coastal boundary may also be subject to coastal site plan review through P&Z for work that changes grade or drainage near tidal water; confirm scope with P&Z before work starts.

Septic

Ox Ridge, Middlesex Road, Hollow Tree Ridge, and much of the two-acre country north of the Post Road is on septic. Sod goes over a leach field; loaded trucks and skid steers do not, and topsoil over a field stays thin. Locate the tank and the field before the first pallet is staged.

Crew Hours: No Adopted Ordinance Found

This is the fact that separates Darien from its neighbors. Greenwich stops machine work at 6 p.m. and bans it on Sundays. New Canaan runs 7 to 7 with a 10-to-4 Sunday window. Westport allows 7 a.m. to 8 p.m. No adopted hours-based ordinance has been found in Darien as of September 2026. Section 31-7 of the town code adopts the state’s noise regulations, Regulations of Connecticut State Agencies 22a-69, which set decibel limits at the property line for daytime and nighttime, not permitted hours.

In September 2023 the Board of Selectmen sent the RTM suggestions for an hours-based ordinance: landscape services 8 a.m. to 8 p.m. Monday through Saturday and 8 a.m. to 3 p.m. Sundays and holidays, with no construction limits proposed. As of September 2026, that proposal has not been adopted. This page does not constitute legal advice; confirm current requirements with the town before work starts.

Leaf Blowers

No adopted Darien restriction on gas-powered leaf blowers has been found as of September 2026. A Connecticut OLR report from 2024 lists the towns with restrictions; Darien is not among them. Darien was conducting a community survey on gas-powered blower policy in August 2026, per a Darien Patch report; the outcome of that survey is not yet determined. On the Greenwich line and the Westport line, the other town’s rule applies the moment the truck crosses it.

Watering: Aquarion’s Two Days

Darien has been on Aquarion’s mandatory twice-weekly sprinkler schedule since it launched in 2017, and the 2026 schedule runs April 1 through October 31.

Drip, soaker hoses, and hand-held watering are allowed at any time. New sod qualifies for a New Planting Variance from the schedule; apply through the Aquarion variance application before the install, not after the first hot day. The variance is not available in July or August. The schedule applies to automatic and hose-end sprinklers; the first two weeks of a fall install on a Tokeneke lot are usually a hand-held job at dawn anyway, because the wind off the Sound dries the surface by noon.

Fertilizer

Connecticut’s lawn-fertilizer law applies statewide: no application from December 1 through March 15, nothing within 20 feet of water, and phosphorus only where a soil test or new establishment calls for it. New sod is the establishment exception for phosphorus; that does not mean every phosphorus starter belongs under sod—what belongs under sod is UNDER SOD™, a specific product applied at the rate of one 25-pound bag per pallet. When to Install Sod in Darien

September and October are the strongest window: warm soil, cool nights, lower weed pressure, and the fall rain that Long Island Sound tends to hold back until late in the month. April through early June is the second window, with one Darien-specific caution; a shore lot that was underwater in a March nor’easter is a salt-flush conversation before it is a sod conversation.

July and August installs work on irrigated properties, and only there. Aquarion’s New Planting Variance is not available in July or August, so those months depend on hand-watering off schedule days. An unirrigated Ox Ridge lawn laid in July on clay is a September re-lay.

Darien Lot Math

Three typical Darien lawns, sized the way the crew sizes them. Pallets at 500 square feet with 5 percent waste; topsoil at 3 and 4 inches; tri-axle loads at 20 yards; establishment water at a quarter inch a day.

The Tokeneke line is the one that gets underestimated. Twelve thousand square feet is not a big lawn, but a Tokeneke driveway may not take a tractor-trailer, which means a straight truck and two trips, and ledge under the old lawn means the 4-inch topsoil row, not the 3-inch one.
